The Federal High Court in Abuja has fixed November 26, 2026, to deliver judgment in a legal dispute over the Nigeria Democratic Congress (NDC) senatorial ticket for Edo South ahead of the 2027 general election.
Justice Joyce Abdulmalik fixed the date on Monday after lawyers representing the parties adopted their final arguments in the suit filed by former House of Representatives member, Ehiozuwa Agbonayinma.
Agbonayinma, who represented Egor/Ikpoba Federal Constituency, is challenging what he described as the unlawful substitution of his name after the NDC’s May 29 senatorial primary.
The suit, marked FHC/ABJ/CS/1250/2026, lists the Independent National Electoral Commission (INEC), the NDC, Osayuki Asemota and Sunday Aguebor as defendants.
Agbonayinma told the court that he secured the highest number of lawful votes at the party’s primary and should therefore be recognised as the winner and candidate for Edo South Senatorial District.
He is asking the court to set aside the nomination or submission of Asemota or Aguebor as the NDC candidate and direct the party to recognise and submit his name to INEC as its duly nominated candidate.
However, Aguebor, through his lawyer, R.O. Isenalumhe, filed a counter-affidavit in which he claimed that he defeated Agbonayinma in the primary and urged the court to grant his own reliefs.
The dispute has also previously generated controversy over the name and photograph displayed for the NDC candidate on the INEC portal, with party officials giving conflicting accounts of who emerged from the primary and who should represent the party.
