The United States Customs and Border Protection (CBP) agency will cease collecting import tariffs that were recently struck down as illegal by the Supreme Court of the United States, beginning 12:01 a.m. Eastern Time today (Tuesday, February 24, 2026). 


CBP announced in a message to shippers that it will de-activate all tariff codes tied to tariffs imposed under the International Emergency Economic Powers Act (IEEPA)  the emergency authority former President Donald Trump used to levy broad import duties after the court ruled those tariffs were outside presidential authority. 


The halt affects only those IEEPA-based tariffs ruled unlawful; other levies, such as tariffs imposed under separate legal provisions related to national security or unfair trade practices (like Section 232 or Section 301 measures), will remain in effect. 


The decision comes several days after the Supreme Court declared the IEEPA tariffs illegal, reflecting a major legal check on executive power in trade policy and setting the stage for questions about possible refunds to importers who already paid those duties. Economists estimate that more than $175 billion in tariff revenue could be subject to refund claims if courts or legislation require repayment. 


Meanwhile, the Trump administration has moved to introduce a new 15 percent global tariff under a different statutory authority to replace the struck-down IEEPA levies, signalling continued tensions over US trade policy.
