Former Kaduna State Governor Nasir El-Rufai has filed a legal application asking the Federal High Court in Abuja to dismiss the criminal charges filed against him by the Department of State Services (DSS) and is also seeking ₦2 billion in compensation from the agency for what he describes as an abuse of the court process.
The motion concerns Charge No. FHC/ABJ/CR/99/2026, which the DSS filed on February 16, 2026. El-Rufai argues that the charges are incompetent, disclose no offence known to law and constitute a gross abuse of the judicial process, urging the court to quash the case and discharge him before it proceeds to trial.
El-Rufai’s legal team also wants the court to award ₦2 billion in costs against the DSS, claiming the prosecution is a misuse of the criminal justice system that has subjected him to harassment, embarrassment and public victimisation. The matter is scheduled for hearing on February 25, 2026, before Justice Joyce Abdulmalik.
The application lists multiple grounds for dismissal, including alleged constitutional breaches, lack of a prima facie case, duplicity, absence of credible evidence, prosecutorial incompetence and bad faith, and alleges political persecution as part of the DSS action.
