The Performing Musicians Employers Association of Nigeria (PMAN) wishes to reaffirm that President Pretty Okafor has fully met and exceeded all the constitutional requirements necessary for his continued leadership of the association. Despite recent attempts by a faction of disgruntled members to undermine his authority, President Okafor has emerged stronger, setting an unprecedented standard for leadership within PMAN.

Attempts to Undermine Leadership Thwarted by Constitutional Integrity

Recently, while President Pretty Okafor was out of the country, actively promoting PMAN and seeking new opportunities for the association, a small group within the National Working Committee (NWC) attempted to suspend him from his role. This action was not only premature but also procedurally improper according to the PMAN Constitution. The NWC, acting beyond its jurisdiction, failed to adhere to the required processes as stipulated in our governing document.

The PMAN Constitution, particularly Articles 11 (B) and 11 (H), clearly outlines the composition and quorum requirements for the National Executive Council (NEC) to make any binding decisions. The NEC, composed of 31 members, requires a quorum of at least one-third of its total membership, which is 11 members, to conduct valid meetings and take decisions. The NEC is the only body vested with the authority to make decisions regarding the suspension of the President or any other officer. This authority does not extend to the NWC, which is subordinate to the NEC.

President Pretty Okafor: A Leader Committed to Due Process and the PMAN Constitution

President Pretty Okafor’s response to these unfounded attempts at suspension has been nothing short of exemplary. It is important to reiterate that, according to the PMAN Constitution, the NWC does not have the jurisdiction to suspend the President or any other NEC member. Article 18 of the PMAN Constitution explicitly states that any suspension must be based on a finding of guilt by a properly constituted Disciplinary Committee. Moreover, no such committee had been appointed before the NWC's attempt to suspend President Okafor, making the action not only procedurally improper but also unconstitutional.

The NEC has since directed the NWC to maintain the status quo regarding President Okafor’s position and those of the Chapter Governors/Sole Administrators. No further actions should be taken by the NWC until a full hearing is conducted by the National Disciplinary Committee (NDC), ensuring fairness and adherence to due process.
